1. Introduction

Welcome to Drift Canvas. These Terms and Conditions ("Terms") govern your use of the Drift Canvas website (the "Site") located at driftcanvas.site and the photography services provided by Drift Canvas ("Services").

By accessing the Site, booking our Services, or signing a service agreement with us, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Site or use our Services.

2. Services

Drift Canvas provides professional photography services, including but not limited to:

  • Wedding photography
  • Portrait photography
  • Event photography
  • Commercial photography

All Services are subject to availability and confirmation of reservation.

3. Bookings and Reservations

3.1 Booking Process

To book our Services, you must:

  • Complete and submit a booking inquiry through our Site or contact us directly
  • Receive confirmation of our availability for your requested date and service
  • Pay the required deposit
  • Receive a booking confirmation from us

3.2 Deposits

A non-refundable deposit of 50% of the total service fee is required to secure your booking. The deposit will be applied to the total cost of the Services. Your booking is not confirmed until we receive your deposit and provide you with written confirmation.

3.3 Final Payment

The remaining balance is due:

  • For weddings: 30 days before the event date
  • For portraits and commercial shoots: 7 days before the scheduled session
  • For events: 14 days before the event date

If the final payment is not received by the due date, we reserve the right to treat the booking as canceled, and the deposit will not be refunded.

4. Rescheduling and Cancellations

4.1 Rescheduling by Client

Requests to reschedule must be made in writing:

  • For weddings: At least 60 days before the event date
  • For portraits and commercial shoots: At least 14 days before the scheduled session
  • For events: At least 30 days before the event date

Rescheduling is subject to our availability. If we cannot accommodate your new date, our cancellation policy will apply.

4.2 Cancellation by Client

If you cancel your booking, the following terms apply:

  • For weddings:
    • Cancellation more than 90 days before the event date: Deposit is non-refundable
    • Cancellation 30-90 days before the event date: 75% of the total fee is due
    • Cancellation less than 30 days before the event date: 100% of the total fee is due
  • For portraits and commercial shoots:
    • Cancellation more than 14 days before the session: Deposit is non-refundable
    • Cancellation 7-14 days before the session: 50% of the total fee is due
    • Cancellation less than 7 days before the session: 100% of the total fee is due
  • For events:
    • Cancellation more than 30 days before the event: Deposit is non-refundable
    • Cancellation 14-30 days before the event: 75% of the total fee is due
    • Cancellation less than 14 days before the event: 100% of the total fee is due

All cancellations must be made in writing.

4.3 Cancellation or Rescheduling by Drift Canvas

In the unlikely event that we need to cancel or reschedule due to illness, emergency, or other unforeseen circumstances:

  • We will attempt to find a suitable replacement photographer of similar style and experience
  • If no replacement is available and we must cancel, we will refund 100% of any payments made
  • Our liability is limited to the return of all payments made

5. Service Delivery

5.1 Photography Coverage

We will provide coverage as agreed in your booking. While we will make every effort to capture all requested photographs, we cannot guarantee specific shots. Photography is subject to weather conditions, venue restrictions, time limitations, and cooperation of individuals.

5.2 Delivery Timeline

Edited images will be delivered within:

  • Weddings: 4-6 weeks after the event
  • Portraits: 2-3 weeks after the session
  • Events: 2-4 weeks after the event
  • Commercial projects: As specified in the project agreement

Delivery times may be extended during peak seasons. Rush delivery is available for an additional fee.

5.3 Image Selection and Editing

We have full creative control over image selection and editing. Our editing style is consistent with the samples in our portfolio. We do not provide RAW files or unedited images.

5.4 Image Quantity

The number of final images delivered will depend on the package selected and the nature of the event. Approximate numbers are:

  • Weddings: 400-600 edited images
  • Portraits: 30-50 edited images
  • Events: 50-100 images per hour of coverage
  • Commercial: As specified in the project agreement

6. Copyright and Usage Rights

6.1 Copyright Ownership

Drift Canvas retains copyright to all images created, as protected by UK Copyright Law. This means we own the intellectual property rights to the photographs.

6.2 Client Usage License

Upon full payment, clients receive a personal, non-exclusive license to:

  • Print the images for personal use
  • Share digital images on personal social media accounts (with photographer credit)
  • Use the images for personal purposes

Clients may not:

  • Sell the images
  • Publish the images commercially without permission
  • Edit, alter, or crop the images
  • Remove watermarks or photographer credit
  • Transfer the license to third parties

Commercial usage rights may be negotiated separately.

6.3 Photographer Portfolio Rights

Drift Canvas reserves the right to use any images created during the provision of Services for promotional purposes, including:

  • Our website portfolio
  • Social media
  • Advertising
  • Publications and contests

If you prefer that your images not be used for promotional purposes, please notify us in writing before your session.

7. Client Responsibilities

As a client, you are responsible for:

  • Providing accurate information for your booking
  • Securing necessary permissions for the photography location, if applicable
  • Informing all attendees about the photography session
  • Cooperating with the photographer's instructions
  • Ensuring punctuality for the scheduled session
  • Informing us about any specific requirements or important shots before the session

For weddings and events, you are responsible for:

  • Providing a detailed timeline at least two weeks before the event
  • Identifying key family members or individuals for group photographs
  • Arranging for the photographer's meal if coverage exceeds 6 hours

8. Limitation of Liability

Drift Canvas's liability is limited to the amount paid for the Services. We are not liable for:

  • Any failure to perform due to circumstances beyond our reasonable control (including but not limited to illness, accidents, poor weather, equipment failure, or other circumstances)
  • Missing or inadequate coverage caused by weather, venue restrictions, or lack of cooperation from individuals
  • Loss of data due to technical failures beyond our control
  • Consequential or indirect losses

We strongly recommend that wedding clients consider wedding insurance to cover potential issues.

9. Website Use

9.1 Content

All content on the Site, including text, graphics, logos, images, and software, is the property of Drift Canvas and is protected by copyright and intellectual property laws.

9.2 Acceptable Use

You may use the Site for lawful purposes only. You are prohibited from:

  • Using the Site in any way that violates applicable laws or regulations
  • Attempting to gain unauthorized access to any part of the Site
  • Engaging in any activity that disrupts or interferes with the Site
  • Reproducing, duplicating, copying, or reselling any part of the Site
  • Introducing viruses, trojans, worms, or other harmful material

10. Miscellaneous

10.1 Governing Law

These Terms are governed by the laws of the United Kingdom. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of the United Kingdom.

10.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

10.3 Entire Agreement

These Terms constitute the entire agreement between you and Drift Canvas regarding the Services and supersede all prior agreements and understandings.

10.4 Amendments

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Site. Your continued use of the Site or Services after such changes constitutes acceptance of the modified Terms.
